1. Acceptance of Terms

By accessing and using pentestdraft ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

pentestdraft is a Software-as-a-Service (SaaS) platform designed for penetration testing teams and security professionals. The Service provides tools for creating, managing, and delivering penetration testing reports, project management, team collaboration, and related features.

3. Account Registration and Security

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring that your use of the Service complies with all applicable laws and regulations

4. Subscription and Payment Terms

Subscription fees are billed in advance on a monthly or annual basis, as selected during registration. All fees are non-refundable except as expressly stated in our Refund Policy. You agree to pay all applicable fees associated with your subscription plan.

We reserve the right to change our pricing with 30 days' notice. Price changes will apply to your next billing cycle after the notice period.

5. Use Restrictions

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Use the Service to transmit any malicious code, viruses, or harmful data
  • Share your account credentials with unauthorized parties
  • Use the Service to compete with pentestdraft or build similar services

6. Intellectual Property Rights

The Service, including its original content, features, functionality, design, and branding, is owned by pentestdraft and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any data, content, or materials you upload or create using the Service ("User Content"). By using the Service, you grant pentestdraft a non-exclusive, worldwide, royalty-free license to use, store, and process your User Content solely for the purpose of providing the Service to you.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We implement reasonable security measures to protect your data, but you acknowledge that no method of transmission over the Internet is 100% secure.

You are responsible for ensuring that any data you upload to the Service complies with applicable data protection laws and that you have obtained necessary consents for processing such data.

8. Service Availability and Modifications

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We reserve the right to:

  • Modify, suspend, or discontinue any part of the Service at any time
  • Perform maintenance that may temporarily interrupt service
  • Update features, functionality, or user interfaces

We will provide reasonable notice of planned maintenance when possible, but are not liable for any damages resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, pentestdraft and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers or your data
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code that may be transmitted through the Service

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless pentestdraft and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any User Content you provide

11. Termination

You may cancel your subscription at any time through your account settings. We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice, for any breach of these Terms or for any other reason we deem necessary.

Upon termination, your right to use the Service will cease immediately. You may request export of your data within 30 days of termination, after which we may delete your data in accordance with our data retention policies.

12. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration body, except where prohibited by law. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

14. General Provisions

These Terms constitute the entire agreement between you and pentestdraft regarding the Service. If any provision is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision shall not be deemed a waiver of such right or provision.

These Terms are governed by the laws of the jurisdiction in which pentestdraft operates, without regard to conflict of law provisions.
